WeFlex Insurance Policy – eligibility criteria and summary of core cover

This Appendix sets out the criteria that must be met for you to be included as a beneficiary under the WeFlex Insurance Policy together with a summary of the core cover under the policy that you need to know about.

Please note that this Appendix sets out a summary of the core cover – not the full terms of the policy. Further details of the terms of the WeFlex Insurance Policy are available from WeFlex on request.

Special Endorsements

Drinks and drugs clause​ If an accident, which happens when the person named against this endorsement number is driving the insured vehicle, results in that person being convicted of an offence involving drink or drugs, or an equivalent offence under the laws of other countries where this insurance provides cover, the cover we provide for that accident is limited to the minimum cover needed to meet the relevant law.

Limited driving exclusion​ We will not provide any cover while your vehicle is being driven by, or is in the charge of, any person under the age of 23.

Any incident, claim, fire or theft must be reported to our claims line as soon as practicable, failure to do so may prejudice our position to defend a claim (whether the policy covers the incident, claim, fire or theft or not).

Reporting an accident

It is important that you call 01908 302 023 to make a claim and report any incident, which might give rise to a claim, whether it is your fault or not and whether you intend to make a claim or not. Alternatively you can email ​zego.insurance@broadspiretpa.co.uk​

Notification of changes

WeFlex are obliged to notify our insurer immediately of any changes which may affect our cover under the WeFlex Insurance Policy. This means that you need to tell us of anything that could affect our cover – since if we are not covered then you will not be covered as a beneficiary. Examples of things to tell us about include:

  • You receive a motoring conviction or have a pending prosecution
  • You suffer from a medical condition or have a claim on another policy
  • You change or modify the Vehicle from the manufacturer’s standard specification
  • You change the address at which the Vehicle is normally kept
  • The Vehicle is involved in an accident no matter how trivial
  • You no longer meet all of the eligibility requirements

This is not a full list, so if there is anything else you think we should know about then, for our and your protection, please tell us immediately.

Accident Cameras

Your vehicle is fitted with a forward facing accident camera. It is your responsibility to ensure this is working at all times. If you are concerned there is an issue with the camera please report it to WeFlex support: support@WeFlex.co.uk or call 020 8033 8713.

It is a condition to the WeFlex Insurance policy that footage is provided for all accidents. It is your responsibility to ensure the footage is preserved, with some of the older vehicles this means unplugging the cameras to maintain the footage (contact WeFlex support if you are unsure how your camera works).

How to read Your Motor Fleet Insurance Policy

The below information is provided by the WeFlex Insurance company ​La Parisienne Assurances. ‘We’ means La Parisienne Assurances.

Your cover

Subject to the terms and conditions of this Motor Fleet Insurance Policy and the receipt of the premium from WeFlex, We will insure WeFlex and the Insured Persons, each as a separate and independent obligation, as follows:

  • We will, in respect of each Lease (in each case for so long as the Lease subsists), insure all persons that constitute Insured Persons in relation to the Third Party Cover; and
  • We will insure WeFlex in relation to Loss or Damage Cover, Fire and Theft Cover and Third Party Cover (the Comprehensive Cover).

It is important for You to know that any Motor Fleet Insurance Policy is subject to certain limitations, exclusions and terms and conditions. It is essential that You are fully aware of what is and what is not covered by this Motor Fleet Insurance Policy and what limitations, exclusions and terms and conditions apply. Please refer to this Motor Fleet Insurance Policy, Your Schedule, Your Certificate of Motor Insurance and any Endorsements for full details of your arrangement with Us. You should pay particular attention to the General Exclusions and General Conditions.

Your cover is arranged by Extracover Limited (trading as ZEGO) on behalf of the Insurer.

Your Insurer

La Parisienne Assurances is a French insurance company with its headquarters at 120 – 122 rue Réaumur, 75083 Paris, Cedex 02, France. La Parisienne Assurances trading as La Parisienne Assurance is authorised by the Autorité de Contrôle Prudentiel et de Resolution (ACPR) in France and subject to limited regulation by the Financial Conduct Authority in the UK, with firm reference number 517214.

ZEGO

Extracover limited (trading as ZEGO) is an authorised Insurance Intermediary with a registered address of 25 Luke Street, London, EC2A 4DS, UK. ZEGO is authorised and regulated by the Financial Conduct Authority, with firm reference number 757871. This can be checked on the Financial Services Register at https://register.fca.org.uk or by calling the Financial Conduct Authority on 0800 111 6768.

The Contract of Insurance

This Motor Fleet Insurance Policy is a contract of insurance solely between WeFlex and the Insurer and consists of this Motor Fleet Insurance Policy, WeFlex’s Certificate of Motor Insurance, WeFlex’s Schedule and any Endorsements entered into between WeFlex and the Insurer.

The parties do not intend that any term of this contract of insurance should be enforceable, by virtue of the Contracts (Rights of Third Parties) Act 1999, by any person who is not a party to this contract of insurance.

Please read Your Motor Fleet Insurance Policy, Schedule, Certificate of Motor Insurance and any Endorsements carefully to ensure Your cover meets your requirements and the details are correct. These are legal documents, please keep them in a safe place.

The information and statements provided by You have been relied upon by Us in entering into this insurance contract. You must notify Us as soon as possible of any changes which affect Your Motor Fleet Insurance Policy and which have occurred either since the cover started or since the last renewal date. If You do not tell Us about relevant changes, Your Motor Fleet Insurance Policy may not be valid or may not cover You fully.

Your cover is effective in the United Kingdom only, except where We must provide cover outside the United Kingdom under the Road Traffics Acts (as further explained below in Section 3 Part 4).

None of the terms and conditions of this Motor Fleet Insurance Policy will restrict the obligations We have as an insurer of compulsory insurance, specifically in relation to Our obligations under the Road Traffic Acts.

Disclosure (Information You Must provide to Us)

You have a duty to make a fair presentation of the risk which You wish Us to insure. This applies prior to the start of your Motor Fleet Insurance Policy, prior to entering into any Endorsement during the Period of Insurance and prior to each renewal. If You are in doubt about how to make a fair presentation of risk please contact ZEGO who can assist You.

If the failure to make a fair presentation of the risk is deliberate or reckless:

  • We may avoid the Motor Fleet Insurance Policy, and refuse to pay all claims; and
  • We need not return any of the premiums paid.

If the failure to make a fair presentation is not deliberate or reckless, Our remedy will depend on what We would have done if You had complied with the duty of fair presentation:

  • If We would not have entered into the Motor Fleet Insurance Policy at all, We may avoid the contract and refuse all claims, but must return the premiums paid;
  • If We would have entered into the Motor Fleet Insurance Policy, but on different terms (other than terms relating to the premium), the Motor Fleet Insurance Policy is to be treated as if it had been entered into on those different terms from the outset, if We require.
  • If We would have entered into the Motor Fleet Insurance Policy, but would have charged a higher premium, We may reduce proportionately the amount to be paid on a claim (and, if applicable, the amount already paid on prior claims).

If things go wrong and You have a complaint, We would like to know about it. Please contact ZEGO at support@zego.com.

ZEGO will try to resolve the matter to Your satisfaction. If You are not satisfied with ZEGO’s response, You can also contact Us directly at:

If the complaint cannot be resolved within 8 weeks, You will receive a ‘final response letter’ from Us and

Law applicable to this Motor Fleet Insurance Policy

This Motor Fleet Insurance Policy is governed by English Law and is subject to the exclusive jurisdiction of the English Courts.

Language

The language for this Motor Fleet Insurance Policy and communication will be English.

Currency

All monies payable under this Motor Fleet Insurance Policy will be paid in Pounds Sterling, unless specified to the contrary.

Definitions

The following key words or phrases, which are listed below in alphabetical order, have the same meaning whenever they appear.

Approved Repairer

A motor vehicle repairer authorised by Us or Our representative to repair an Insured Vehicle following a valid claim made by You under Section 1 or Section 2 of this Motor Fleet Insurance Policy.

Audio Equipment

Radios, cassette players and CD players permanently fitted to an Insured Vehicle. Two-way radio equipment is not included in this definition.

Certificate of Motor Insurance

A document which is evidence of the existence of Your Motor Fleet Insurance as required by law in respect of each vehicle in your fleet and which forms part of this contract of insurance. The Certificates of Motor Insurance must be read in conjunction with this Motor Fleet Insurance Policy.

Comprehensive Cover

This level of cover includes Loss or Damage Cover, Fire and Theft Cover and Third Party Cover, as set out in Sections 1-3 of this Motor Fleet Insurance Policy.

Court of Summary Jurisdiction

A Magistrates Court or a court of equivalent jurisdiction in the United Kingdom.

Courtesy Car

A car loaned to You by our Approved repairer whilst an Insured Vehicle is being repaired following a valid claim under section 1 or section 2 of this insurance.

Endorsement

A change in terms and conditions of Your Motor Fleet Insurance Policy which replaces, supplements or alters the standard terms and conditions of the Motor Fleet insurance Policy contained in this Motor Fleet Insurance Policy. Any Endorsement will be printed on or issued with the Schedule.

Excess

The total amount You will have to pay towards the cost of a claim for loss of or damage to an Insured Vehicle, whether or not the incident giving rise to the claim is Your fault. Different Excesses may apply to different sections of this Motor Fleet Insurance Policy.

Fire

Fire, lightning, explosion or self-ignition.

Fire and Theft Cover

This is the cover described in Section 2 of this Motor Fleet Insurance Policy.

Geographical Limits

The United Kingdom of Great Britain and Northern Ireland.

Hazardous Goods

  • Petrol and liquid petroleum gas transported in bulk, explosives or chemicals of a volatile, explosive, corrosive or toxic nature, and/or
  • Any goods listed in Classes 1 to 9 of the Health and Safety Executive (HSE) rules relating to the carriage of dangerous goods. The rules require the display of hazard warning (ADR or Hazchem) panels and that the driver of the vehicle carries a Tremcard.

Hirer

This is any person who hires a vehicle from WeFlex.

Insurance Intermediary

The intermediary who has placed this insurance with Us, acting on Your behalf as Your agent and through whom all matters concerning this insurance are handled.

Insured Vehicle

Each vehicle described in Your Schedule or any replacement vehicle which has been notified to and accepted by Us, and for which You have a Certificate of Motor Insurance showing the registration number.

Insured Persons

Any of the following persons in respect of a Lease:

  • Any person permitted to drive an Insured Vehicle under a Lease with you (a Hirer);
  • Any person who is named on the Certificate of Insurance as a permitted driver in respect of the Hirer’s

Insured Vehicle (a Permitted Driver);

  • Any person using (but not driving) an Insured Vehicle with the Hirer’s permission; and
  • The legal representatives of any person who dies and who would have been covered under this definition.

Lease

The hire purchase or leasing agreement which is entered into by WeFlex and the Hirer of an Insured Vehicle.

Loss or Damage Cover

This is the cover described in Section 1 of this Motor Fleet Insurance Policy.

Malicious Damage

Damage caused to an Insured Vehicle as a result of an intentional or reckless act.

Market Value

The cost, in the reasonable opinion of an independent motor engineer, of replacing an Insured Vehicle with a vehicle of the same make, model and of similar pre-loss or damage condition, specification, mileage and age.

Motor Fleet Insurance Policy

The documents consisting of the Motor Fleet Insurance Policy, Your Certificate of Motor Insurance and/or Schedule and any Endorsements.

Period of Insurance

The period shown in Your Schedule and Certificate of Motor Insurance for which We have agreed to cover You and for which You have paid or agreed to pay a premium.

Permitted Driver

In respect of each Lease, any person who is named on the Certificate of Motor Insurance as a permitted driver in respect of the Hirer’s Insured Vehicle.

Personal Effects

Property which is worn or used in everyday life and which belongs to You or any passenger in an Insured Vehicle.

Private Hire

The use of a passenger carrying vehicle for the carriage of passengers for hire and reward.

Road Traffic Acts

The compulsory motor insurance provisions of any road traffic acts, laws or regulations that govern the driving or use of any motor vehicle in the United Kingdom including but not limited to the Road Traffic Act 1998 (as amended).

Schedule

The document giving details of the Period of Insurance, Your cover, the premium, the Excess, the Insurer and the policy number. The Schedule includes certain details of the information You provided on a proposal form or otherwise to obtain a quotation and forms the basis of Your contract with Us.

Theft

Theft, attempted theft or the taking away of an Insured Vehicle without Your consent.

Third Party Cover

This is the cover described in section 3 of this Motor Fleet Insurance Policy.

We/Us/Our/Insurer

ZEGO / The Claims Administrator

Extracover Limited trading as ZEGO (registered in England & Wales, number 10128841 whose registered office is at 25 Luke Street London EC2A 4DS UNITED KINGDOM) or any successor claims administrator.

Section 1 – Loss or Damage Cover

1 Loss of or Damage to an Insured Vehicle

What is covered

We will cover You against loss or damage to the Insured Vehicle (less any Excess that applies) caused accidentally or as a result of Malicious Damage or vandalism. Loss or damage covered under “Windscreen Cover” and “Audio, Communication and Navigation Equipment” will be covered under the terms of those specific sections.

We will also cover You under this section while the Insured Vehicle is in the custody of a member of the motor trade for servicing or repair.

Under this section We may either:

  • pay for the damage to be repaired at an Approved Repairer, or
  • with Your agreement provide a replacement vehicle, or
  • pay an amount of cash equivalent to the loss or damage

What is the most We will pay?

We will, at Our sole discretion either:

(a)  Pay the cost of repairs at an Approved Repairer or pay You a sum equal to the Market Value of the Insured Vehicle where the Insured Vehicle is damaged beyond economic repair; or

(b)  Replace the Insured Vehicle with a vehicle of the same Market Value or pay You a sum equal to the Market Value of the Insured Vehicle where the Insured Vehicle is stolen and not recovered or is damaged beyond economic repair. The stolen or damaged vehicle will then at Our discretion become the property of the Insurer.

The definition of Market Value at the start of Your Motor Fleet Insurance Policy sets out the basis on which We will calculate the value of the Insured Vehicle for the purposes of settling a claim where the Insured Vehicle is beyond economic repair.

We will not pay:

  • More than the Market Value of the Insured Vehicle at the time of loss or damage.
  • The amount of any repair or replacement which improves the Insured Vehicle beyond its condition before the loss or damage.
  • More than the last United Kingdom list or quoted price for any parts or accessories which have become unobtainable or are no longer manufactured in the United Kingdom.
  • We may at our sole discretion use parts that have not been supplied by the original manufacturer to repair the Insured Vehicle. These parts will be subject to the Approved Repairer’s guarantee. If You insist that We use parts supplied by the original manufacturer despite alternative non-original manufacturer parts being available, You will be liable to bear the difference in the cost of such parts.
  • More than £250 in respect of advertisements, sign-writing, specialist paintwork or logos if included in declared value. This amount is also subject to the deduction of any Excess in the Schedule, this Motor Fleet Insurance Policy document or both.

If the Insured Vehicle is not operational or disabled as a direct result of damage covered by this Section, We will pay the reasonable cost of transporting the Insured Vehicle to the nearest Approved Repairer and the reasonable cost of delivery of the Insured Vehicle, following repair, to Your address in the United Kingdom.

If to Our knowledge the Insured Vehicle belongs to someone else or is the subject of a hire purchase or leasing agreement, payment for the total loss or destruction of the Insured Vehicle will normally be made to the legal owner (whose receipt will be full and final discharge of our obligations under this Motor Fleet Insurance Policy) rather than to You.

Protection and Recovery

If the Insured Vehicle cannot be driven following an incident leading to a valid claim under this section, We will pay:

  • the cost of its protection and removal to the nearest Approved Repairer or place of safety, and
  • the reasonable cost of re-delivery to Your home or business address within the United Kingdom after the completion of repairs, and
  • the cost of storage of the Insured Vehicle incurred with our written consent.

If the Insured Vehicle is damaged beyond economical repair We will arrange for it to be stored safely at premises of Our choosing.

You should remove Your Personal Effects from the Insured Vehicle before it is collected from You.
In the event of a claim being made under this Motor Fleet Insurance Policy. We have the right to remove the Insured Vehicle to an alternative repairer or place of safety at any time in order to keep the cost of the claim to a minimum.

Excess

You will be responsible for paying the amount shown on the Schedule in respect of any claim relating to loss of or damage to the Insured Vehicle.

What is covered

Audio, Communication and Navigation Equipment

What is covered

Subject to the terms and conditions, exclusions and limitations set out in this Motor Fleet insurance Policy, We will pay for loss of or damage to the Insured Vehicle’s original manufacturer permanently fitted Audio Equipment and visual equipment and components including taxi meters and two-way radios (excluding mobile telephones, cassettes, tapes, discs, iPod/MP3 players, iPad/tablets).

What is the most We will pay?

The maximum amount We will pay is £500. This amount is also subject to the deduction of any Excess in the Schedule, this Motor Fleet Insurance Policy document or both.

We will not pay more than the value of the equipment at the time of the loss or damage, after making a reasonable deduction for wear and tear.

Medical Expenses

We will pay up to £250 per person for medical expenses for anyone who is injured while they are in the Insured Vehicle.

What is not covered under Section 1

You will have to pay the total Excess specified in Your Schedule in respect of each claim for loss of or damage to the Insured Vehicle. The amount of the Excess may vary according to the nature of the claim and as such, there may be more than one statement of Excess shown in Your Schedule.

We will not provide cover for:

  • The amount of any Excess shown on the Schedule or in this Motor Fleet Insurance Policy or both.
  • Any amount greater than £500 in respect of any one occurrence for loss or damage caused to Audio Equipment. This amount is also subject to the deduction of any Excess in the Schedule, this Motor Fleet

Insurance Policy or both.

  • VAT if You are VAT registered.
  • Indirect losses, which result from the incident that caused You to claim. For example We will not pay compensation for You not being able to use the Insured Vehicle.
  • Wear and tear, mechanical or electrical breakdown including failure of any equipment, integrated circuit, computer chip, computer software or computer related equipment and failure or breakages of any part due to application of brakes or road shocks.
  • Depreciation or loss of value following repairs.
  • Loss of or damage to the Insured Vehicle arising from the vehicle being taken by a person:
  • who is not permitted to drive under the Certificate of Motor Insurance, and
  • who is also Your employee or a member of Your family or household or in a close personal relationship with You or Your family or household unless You prove that the person intended to permanently deprive the owner of the vehicle.
  • Loss suffered due to any person obtaining any property by fraud or deception, for example a purchaser’s cheque not being honoured by their bank.
  • Loss or damage to the Insured Vehicle where possession of it is gained by deception on the part of someone pretending to be a buyer or someone pretending to act on behalf of a buyer.
  • Loss or damage caused by pressure waves from aircraft or any flying object.
  • Damage to tyres caused by braking, punctures, cuts or bursts.
  • Repairs, re-programming or replacement of any component, including locks on the Insured Vehicle, resulting from the loss of or damage to the vehicle’s keys, keyless entry cards, lock or ignition activators or alarm or immobiliser activators.
  • Loss of or damage to the Insured Vehicle or anything inside it arising from Theft when:
  • ignition keys have been left in or on the Insured Vehicle, or
  • the Insured Vehicle has not been secured by means of all door locks, or
  • any window or any form of sliding or removable roof or hood have been left open or unlocked.
  • Loss or damage caused by an inappropriate type or grade of fuel being used.
  • Confiscation, requisition or destruction by or under the order of any Government or Public or Local Authority.
  • More than £250 in respect of sign-writing, advertisements, logos or specialist paintwork. This amount is also subject to the deduction of any Excess in the Schedule, this Motor Fleet Insurance Policy or both
  • Loss or damage caused directly or indirectly by fire if the Insured Vehicle is equipped for cooking and/or heating of food or drink.
  • Loss of or damage to any item of sound reproduction, communications, navigation or in- vehicle entertainment equipment other than to Audio Equipment.
  • Loss or damage whilst the Insured Vehicle is being driven by or is in the charge of any person who:

1) is subsequently convicted of a drink/drugs offence as a result of the incident leading to a claim under this Motor Fleet Insurance Policy, or
2) is subsequently proven to have been under the influence of drink/drugs at the time of the incident leading to a claim under this Motor Fleet Insurance Policy.

  • Loss of or damage to taxi metering or ticketing equipment.

Section 2 – Fire and Theft Cover

1 Loss of or Damage to Your Car

What is covered

We will cover You against loss of or damage to the Insured Vehicle (less any Excess that applies) caused by Fire or Theft.
Cover also applies under this section while the Insured Vehicle is in the custody of a member of the motor trade for servicing or repair.

Under this section We may either:

  • pay for the damage to be repaired by an Approved Repairer, or
  • with Your agreement provide a replacement vehicle, or
  • pay an amount of cash equivalent to the loss or damage.

What is the most We will pay?

We will, at Our sole discretion:

(a)  Pay the cost of repairs or pay You a sum equal to the Market Value of the Insured Vehicle is damaged beyond economic repair; or

(b)  Replace the Insured Vehicle with a car of the same Market Value or pay You a sum equal to the Market Value of the Insured Vehicle where the Insured Vehicle is stolen and not recovered or is damaged beyond economic repair. The stolen or damaged vehicle will then at Our discretion become the property of the Insurer.

The definition of Market Value at the start of Your Policy sets out the basis on which We will calculate the value of the Insured Vehicle for the purposes of settling a claim where the Insured Vehicle is beyond economic repair.

We will not pay:

  • More than the Market Value of the Insured Vehicle at the time of loss or damage;
  • The amount of any repair or replacement which improves the Insured Vehicle beyond its condition before the loss or damage;
  • More than the last UK list or quoted price for any parts or accessories which have become unobtainable or are no longer manufactured in the United Kingdom;
  • We may at Our sole discretion use parts that have not been supplied by the original manufacturer to repair the Insured Vehicle. These parts will be subject to the Approved Repairer’s guarantee. If You insist that We use parts supplied by the original manufacturer despite alternative non-original manufacturer parts being available, You will be liable to bear the difference in the cost of such parts;
  • More than £250 in respect of advertisements, sign-writing, specialist paintwork or logos if included in declared value. This amount is also subject to the deduction of any Excess in the Schedule, this Motor Fleet Insurance Policy document or both.

If to our knowledge the Insured Vehicle belongs to someone else or is the subject of a hire purchase or leasing agreement, payment for the total loss or destruction of the Insured Vehicle will normally be made to the legal owner (whose receipt will be a full and final discharge to Us) rather than to You.

If the Insured Vehicle is disabled or not operational as a direct result of damage covered by this Section, We will pay the reasonable cost of transporting the Insured Vehicle to the nearest repairer the reasonable cost of delivery following repair to Your address in United Kingdom.

Excess

You will be responsible for paying the amount shown on the Schedule in respect of any claim relating to loss of or damage to the Insured Vehicle caused by Fire or Theft.

What is not covered under Section 2

You will have to pay the total Excess specified in Your Schedule in respect of each claim for loss of or damage to the Insured Vehicle. The amount of the Excess may vary according to the nature of the claim.

We will not provide cover for:

  • The amount of any Excess shown on the Schedule or in this Motor Fleet Insurance Policy or both.
  •  VAT if You are VAT registered.
  •  Indirect losses, which result from the incident that caused You to claim. For example We will not pay compensation for You not being able to use the Insured Vehicle.
  • Wear and tear, mechanical or electrical breakdown including failure of any equipment, integrated circuit, computer chip, computer software or computer related equipment and failure or breakages of any part due to application of brakes or road shocks.
  •  Depreciation or loss of value following repairs.
  •  Loss of or damage to the Insured Vehicle arising from the vehicle being taken by a person:

1)  who is not permitted to drive under the Certificate of Motor Insurance, and

2)  who is also Your employee or a member of Your family or household or in a close personal relationship with You or Your family or household unless You prove that the person intended to permanently deprive the owner of the vehicle.

  •  Loss suffered due to any person obtaining any property by fraud or deception, for example a purchaser’s cheque not being honoured by their bank.
  •  Loss or damage to the Insured Vehicle where possession of it is gained by deception on the part of someone pretending to be a buyer or someone pretending to act on behalf of a buyer.
  •  Loss or damage caused by pressure waves from aircraft or any flying object.
  •  Damage to tyres caused by braking, punctures, cuts or bursts.
  •  Repairs, re-programming or replacement of any component, including locks on the Insured Vehicle, resulting from the loss of or damage to the vehicle’s keys, keyless entry cards, lock or ignition activators or alarm or immobiliser activators.
  •  Loss of or damage to the Insured Vehicle or anything inside it arising Theft when:
    • ignition keys have been left in or on the Insured Vehicle, or
    • the Insured Vehicle has not been secured by means of all door locks, or
    • any window or any form of sliding or removable roof or hood have been left open or unlocked.
  •  Loss or damage caused by an inappropriate type or grade of fuel being used.
  •  Confiscation, requisition or destruction by or under the order of any Government or Public or Local Authority.
  •  More than £250 in respect of sign-writing, advertisements, logos or specialist paintwork. This amount is also subject to the deduction of any Excess in the Schedule, this Motor Fleet Insurance Policy or both
  •  Loss or damage caused directly or indirectly by fire if the Insured Vehicle is equipped for cooking and/or heating of food or drink.
  •  Loss of or damage to any item of sound reproduction, communications, navigation or in- vehicle

entertainment equipment other than to Audio Equipment.

  •  Loss or damage whilst the Insured Vehicle is being driven by or is in the charge of any person who:

1) is subsequently convicted of a further drink/drugs offence as a result of the incident leading to a claim under this Motor Fleet Insurance Policy, or
2) is subsequently proven to have been under the influence of drink/drugs at the time of the incident leading to a claim under this Motor Fleet Insurance Policy.

  • Loss of or damage to taxi metering or ticketing equipment.

Section 3 – Third Party Cover

1 Your Legal Liability to Other People

What is covered

Use of the Insured Vehicle

We will cover You and any Insured Person for their legal liability for death, bodily injury or damage to property arising out of the use of the Insured Vehicle or an attached trailer or caravan:

Third party property damage limit

The cover provided for damage to property is limited to £ 20,000,000 in respect of any one occurrence or series of occurrences arising out of one event.

Legal costs

We will pay (with our prior written consent):

  • solicitors’ fees for representing You at any fatal accident enquiry, coroner’s, or Court of Summary Jurisdiction, and
  • all other reasonable costs and expenses for legal services to defend You against a charge of manslaughter or causing death by careless or inconsiderate driving or dangerous or reckless driving.

We will only pay these legal costs if they arise from an accident that is covered under this Motor Fleet Insurance Policy.

Emergency medical treatment

We will pay for any emergency treatment charges required by the Road Traffic Acts.

Unauthorised movement

We will extend the cover provided by this section to include any legal liability for death, bodily injury or damage to property arising out of the moving aside, with or without the authority of the owner, of an obstructing vehicle if the position of this vehicle prevents the legitimate passage or the loading or unloading of the Insured Vehicle(s). This cover only applies while the obstructing vehicle is being driven by You or Your partner, director or employee.

What is not covered

We shall not be liable, except where such liability must be covered under the Road Traffic Acts:

  • if the person claiming is otherwise insured, or
  • for loss or damage to property belonging to or in the care of You or any person insured under this section or for not being able to use such property, or
  • for damage to the Insured Vehicle or property in it or being conveyed in it or on it or for not being able to use any such property, or
  • for loss or damage to any trailer or caravan being towed by the Insured Vehicle or for not being able to use any such trailer or caravan, or
  • if the death of or bodily injury to any person covered under this section arises out of or in the course of his/her employment , or
  • for death or bodily injury to any person being carried in or on any trailer or caravan, or
  • if a person who was not driving makes a claim and he/she knew that the person driving did not hold a valid driving licence, or
  • for damage to any bridge, viaduct, weigh-bridge or road or anything beneath attributed to vibration or by the weight of the Insured Vehicle and its load if the Insured Vehicle exceeds the maximum gross vehicle, plated or train weight permitted by the relevant law, or
  • for death injury or damage arising while the Insured Vehicle is not on a public road or public place and is in the process of being loaded or unloaded by any person other than the driver or attendant of the Insured Vehicle, or
  • for death, bodily injury, loss or damage arising while the Insured vehicle is working as a tool of trade (this exception does not apply to the normal activities of a goods carrying commercial vehicle or use of the vehicle for private hire), or
  • for death, bodily injury, loss or damage arising from plant forming part of or attached to the Insured vehicle, or
  • for death, bodily injury, loss or damage caused by or attributable to the spraying or spreading of any chemical by an agricultural tractor, self-propelled agricultural or forestry machine or any trailer attached to such a vehicle.

Driving abroad

Legal minimum insurance

While the Insured Vehicle is

  • in any country which is a member of the European Union (EU), or
  • any other country in respect of which the European Commission is satisfied has made arrangements to meet the requirements of Article 8(1), second subparagraph of EU Directive 2009/103/EC relating to civil liabilities arising from the use of motor vehicles

This Motor Fleet Insurance Policy provides You with the minimum level of cover in respect of liability which must be insured in the country concerned. This legal minimum insurance does not include cover for loss of or damage to the Insured Vehicle.

Full policy cover

Private motor cars and commercial vehicles not exceeding 3.5 ton gross vehicle weight which are not used for hire or reward purposes

In addition to the legal minimum cover shown above, this Motor Fleet Insurance Policy may be extended to provide the cover shown in Your Schedule to any member country of the EU and also Andorra, Croatia, Gibraltar, Iceland, Liechtenstein, Monaco, Norway, San Marino and Switzerland provided that:

  • You notify Zego before Your journey abroad, and
  • the use of the Insured Vehicle abroad is limited to no more than 45 days in total in any one annual Period of insurance, and
  • You or any permitted driver are normally resident within the Geographical Limits of this Motor Fleet Insurance Policy, and
  • the Insured Vehicle will not be used for the carriage of goods or passengers for hire or reward whilst outside the United Kingdom (this is regardless of whether the Certificate of Motor Insurance permits this use).

Commercial vehicles exceeding 3.5 ton gross vehicle weight and any vehicle which is used for hire or reward purposes regardless of type or weight

If before departure You notify Us via Your Zego, obtain our agreement, pay any extra premium and accept any additional terms that We may require, We will extend this Motor Fleet Insurance Policy to provide the cover shown on Your Schedule while the Insured Vehicle is in:

  • any member country of the EU, or Andorra, Croatia, Gibraltar, Iceland, Liechtenstein, Monaco, Norway, San Marino or Switzerland. Any agreement to issue cover for these categories of vehicle whilst abroad is at our sole discretion.

If the Motor Fleet Insurance Policy is extended to provide the cover shown on Your Schedule whilst abroad:

  • insurance is automatically provided on the Insured Vehicle while it is being transported (including loading and unloading) between ports in countries where You have cover, provided the Insured Vehicle is being transported by rail or a recognised sea route of not more than 65 hours, and
  • We will pay the reasonable cost of delivery of the Insured Vehicle to You after repairs in the country in which damage was sustained, or to Your home or business address if the damage cannot be repaired economically by the intended time of Your return to the United Kingdom or if the Insured Vehicle is stolen and recovered after Your return to the United Kingdom, and
  • We will pay the amount of foreign customs duty for which You are liable as a direct result of loss or damage to the Insured Vehicle preventing its return to the United Kingdom.

What is not covered under Section 3 We will not cover:

  • Any amount over the limit specified within Your Schedule for any one claim or series of claims from one event in respect of injury to any person not employed by You or damage to property.
  • The amount of excess shown in the Schedule.
  • Any injury to any employee.
  • Any loss or damage to any vehicle owned, leased, hired, or worked upon by You or for which You are legally responsible.
  • Any liability from property and/or premises owned, leased, rented, hired and/or occupied by You or for which You are legally responsible
  • Any liability arising from any product, food or drink sold or supplied by You or for which You are legally responsible.
  • Any liability arising from any other business owned and/or operated by You whether or not related to Your

Private Hire business.

  • Any liability as a result of a malicious or criminal act.
  • Any liability as a result of an attack on a passenger.
  • Any liability for loss of or damage to passengers’ personal effects or luggage for which You are legally responsible.
  • Any liability incurred or injury caused by the provision or administration of drugs to a person in Your care suffering from a known medical condition where You have agreed to provide such treatment as part of

Your contract to transport that person.

  • Any liability arising from wrongful arrest.
  • Punitive or exemplary damages or fines, penalties multiplication of compensatory awards or damages in any other form.
  • Any loss that would not have been covered in the absence of this Motor Fleet Insurance Policy.

Section 4 – General Conditions

The General Conditions apply to Your whole Motor Fleet Insurance Policy

1 Your duties

We will only provide the cover described in this Motor Fleet Insurance Policy if:

  • the premium has been paid for the current Period of insurance or the instalments of the premium due at the relevant time, and
  • You have met all the conditions contained in this Motor Fleet Insurance Policy, the Schedule, the Certificate of Motor Insurance and any Endorsements applied to the insurance cover and so have the Insured Persons (as required by the Lease), and
  • the information You provided or which was provided on Your behalf and which is displayed on Your statement of fact or contained in any declaration is, to the best of Your knowledge and belief, correct and complete, and
  • You provide Us with all co-operation and assistance throughout the duration of this Motor Fleet Insurance Policy, for example if We request information or documentation from You when You purchase cover, make changes, submit a claim or renew, and You take all precautions to prevent loss or damage occurring and the extent of any loss or damage

Your premium is based on information You supplied at the start of the insurance, subsequent alteration or renewal. You must tell Us via Zego as soon as practicable of any change to that information. Some non- exhaustive examples are any changes to the Insured Vehicle from the manufacturer’s standard specification, any change of address (including where vehicles are kept) or if You or any drivers covered by this Motor Fleet Insurance Policy sustain a motoring conviction. This may result Us in requiring You to pay additional premium to maintain the cover under this Motor Fleet Insurance Policy.

You, or anyone acting on Your behalf, when applying for cover, renewing or amending this Motor Fleet Insurance Policy, or making a claim, must not commit a fraudulent act, submit a false document or make a false or exaggerated statement. You must also not amend or alter any document provided by Us under this Motor Fleet Insurance Policy. In the event You do not adhere to any of these requirements, cover under this Motor Fleet Insurance Policy may be declared void or otherwise cancelled immediately and You may not be entitled to a refund of premium. Any claims made against this Motor Fleet Insurance Policy may also not be paid. Where the full premium has not been paid, for example Your payment has failed, been subsequently recalled or You have only paid a deposit, We may seek to enforce payment of the full premium balance.

2 Looking after the Insured Vehicle

You and any Insured Persons are required to maintain the Insured Vehicle in a roadworthy condition. You or any person in charge of the Insured Vehicle are required to take all reasonable care to safeguard it and its contents from loss or damage, for example the vehicle should not be left unlocked and ignition keys should not be left in or on the vehicle when You are not in the vehicle, no matter how briefly.

We shall at all times be allowed free access to examine the Insured Vehicle on reasonable notice.

There must be a valid Department for Transport test certificate (MOT) in force for the Insured Vehicle if one is needed by law. In the absence of a valid Department for Transport test certificate (MOT) required by law all cover under sections 2 and 3 of this insurance will be void and have no effect.

3 Claims procedures

In the event of an accident or incident You must telephone 01908 302 023 or email zego.insurance@broadspiretpa.co.uk immediately or as soon as practicable. If You delay reporting a claim to Us it may increase claim costs, which You may reduce any payment to you. It may also invalidate Your right to claim. If the loss or damage is covered by this Motor Fleet Insurance Policy our Claims Administrator will arrange for the vehicle to be removed to the nearest Approved Repairer, or place of safety, and safeguard the vehicle and its contents.

We will not pay for further damage to the Insured Vehicle if You drive it or attempt to drive it in a damaged condition.

If Your claim is due to Theft, Malicious Damage or vandalism, You must also notify the police and obtain a crime report number.

We have the right to remove the Insured Vehicle at any time. If the vehicle is damaged beyond economical repair We will arrange for it to be stored safely at premises of our choosing.

If We ask to examine driving licences and vehicle documentation before agreeing to settle a claim under this Motor Fleet Insurance Policy You must supply this documentation before We can proceed with the settlement.

Any indication of a claim against You must be notified to Us in writing using the email address above as soon as practicable. Any writ or notification of civil or criminal proceedings should be sent to Us by recorded delivery as soon as practicable.

We shall be entitled to take over and conduct the defence or settlement of any claim or prosecute any claim in the name of any person covered by this insurance.

No admission of liability, payment or promise of payment shall be made or given by You or any person on Your behalf. No proceedings may be commenced against, or settlement accepted from, any other party without our written consent.

We shall have absolute discretion in the conduct of any proceedings or in the settlement of any claim and You must give Us whatever co-operation, information and assistance is necessary.

We will not pay a claim if there is any other insurance in force which covers the same loss, damage or liability as this insurance.

If You owe Us premium or claims monies under this, or any other policy You hold with Us, We will deduct such monies from any valid claim which becomes payable to You under this Motor Fleet Insurance Policy. Such deductions may reduce or remove any liability We owe to You. In the event Your debt is not extinguished or We are unable to deduct the amount owed for any reason, this condition does not prevent Us from pursuing You separately for any balance owed.

4 Right of Recovery

If under the laws of any country in which this insurance applies, We have to make payments which but for those laws would not be covered by this Motor Fleet Insurance Policy, You must repay the amounts to Us.

You or the person who caused the accident must also repay Us any money We have to pay because of any agreement We have with the Motor Insurers’ Bureau if such payment would not have been covered by this Motor Fleet Insurance Policy.

Any payment We make under this condition will mean that there will be no entitlement to a refund of premium if this Motor Fleet Insurance Policy is cancelled or declared void.

5 Motor Insurance Database (MID) and Continuous Insurance Enforcement

It is a condition of this Motor Fleet Insurance Policy that You supply details of all vehicles in Your custody or control to Zego as soon as these vehicles come into Your possession. Your failure to comply with these requirements may result in cancellation being invoked by Us under General condition 4 of this Motor Fleet Insurance Policy.

Continuous insurance enforcement legislation also means that Your vehicles must be insured at all times unless they have been declared by You as ‘off the road’ by way of a SORN declaration.

If there is no record on the MID showing Your vehicle is insured, and You have not declared it as ‘off road’ (by completing a SORN), You will receive a letter warning that You could face a fine, prosecution, and Your vehicle could also be clamped, seized and ultimately, destroyed.

For peace of mind You can check that Your vehicle(s) appear on the MID by going to the MID’s website: www.askMID.com. This will avoid the inconvenience of You/Your drivers being un-necessarily stopped by the police.

If You have insured Your vehicle(s) with Us and it/they do not appear on the MID then You should contact Your Zego in the first instance to get the MID updated.

It is Your legal obligation to make sure that Your vehicle appears on the MID

Section 5 – General Exclusions

The General Exclusions apply to Your whole Motor Fleet Insurance Policy
Your insurance does not cover (except as required under the Road Traffic Acts):

  1. Any liability, loss or damage arising while the Insured Vehicle is being:
  2. a)  used for a purpose which is not permitted or is excluded by the Certificate of Motor Insurance, or
  3. b)  used on a race track, racing circuit or prepared course unless You have told Us about this and We have agreed to provide cover, or
  4. c)  driven by or was last in the charge for that purpose of any person who is not included to drive on Your current Certificate of Motor Insurance or temporary cover note or who is excluded by Endorsement, or
  5. d)  driven by or was last in the charge for that purpose of any person including You who is disqualified from driving, has never held a licence to drive a vehicle or is prevented by law from having a licence, or
  6. e)  driven by or is in the charge for that purpose of any person who does not comply with the terms or conditions of their driving licence, or
  7. f)  driven by or is in the charge for that purpose of any person who does not have Your order or permission to drive the Insured Vehicle, or
  8. g)  driven by or is in the charge for that purpose of any person who holds or last held a provisional driving licence unless that person is accompanied by a full licence holder aged 21 years or over and the accompanying full licence holder has held a full United Kingdom/EU driving licence for at least 3 years, or
  9. h)  used in an unsafe condition either before or after an accident, or
  10. i)  used to convey any load in an unsafe or illegal manner either before or after an accident.

General Exception 1 will not apply

  • if the Insured Vehicle has been stolen or taken away without Your permission, or
  • if the Insured Vehicle is in custody of a garage for repair or servicing.
  • Any loss, damage, death or injury arising as a result of a deliberate or reckless act caused by You or any driver insured to drive.
  • Any liability, loss or damage if the Insured Vehicle has been modified and the modifications have not been notified to and approved by Us.
  • Any liability, loss or damage that occurs outside of the Geographical Limits of this Motor Fleet Insurance Policy (apart from the minimum cover required by law) unless extended under the terms of Section 3 Part 3 of this Motor Fleet Insurance Policy (Driving Abroad).
  • Any liability You have accepted under an agreement or contract unless You would have had that liability anyway.
  • Any legal liability of whatsoever nature directly or indirectly caused by or contributed to or arising from:
    • ionising radiations or contamination by radioactivity from any irradiated nuclear fuel or from any nuclear waste from the combustion of nuclear fuel, or
    • the radioactive toxic explosive or other hazardous properties of any explosive nuclear assembly or nuclear component.
  • Any liability, loss or damage as a consequence of war, invasion or act of foreign enemy, hostilities (whether war be declared or not), civil war, rebellion, revolution, insurrection or military or usurped power.
  • Liability, loss or damage arising from pollution or contamination however caused, other than as required by the Road Traffic Act or the law of any country in which We have agreed to provide cover under this Motor Fleet Insurance Policy.
  • Liability, loss, damage, cost or expense of whatsoever nature directly or indirectly caused by, resulting from or in connection with any act of Terrorism apart from the minimum level of cover We must provide by law.
  • Death, bodily injury, loss, damage and/or liability arising during (unless You prove that it was not occasioned thereby) or in consequence of:
    • earthquake, or
    • riot or civil commotion occurring elsewhere than in Great Britain, the Isle of Man or the Channel Islands.
  • Liability in respect of:
    • any accident, loss or damage to any aircraft, or
    • death or bodily injury arising in connection with accident loss or damage to any aircraft, or
    • any other loss indirectly caused by such accident loss or damage to any aircraft, incurred, caused or sustained while any vehicle covered by this insurance is in any airport or airfield.
  • Death, bodily injury, loss, damage and/or liability resulting from the Insured Vehicle;
    • towing a trailer which has an unsafe or insecure load, or
    • towing a greater number of trailers than is permitted by law, or
    • being used as a tool of trade (other than if the Insured Vehicle is a goods carrying commercial motor vehicle and is being used for the normal activities of a goods carrying commercial vehicle or use of the vehicle for private hire).
  • Loss damage or liability caused by the solidification, spillage, leakage or misdelivery of any load being carried on or being loaded onto or unloaded from the Insured Vehicle.
  • Liability, costs or expenses in respect of any proceedings brought against You or judgement passed in any court outside of the Geographical Limits of this Motor Fleet Insurance Policy. This exception will not apply:
    • in respect of proceedings or judgement arising in connection with any liability which is legally insurable under EU legislation and the proceedings are brought or judgement is passed in a country which is a signatory to Article 8 (1), second sub paragraph of EU Directive 2009/103/EC’, or
    • the proceedings or judgement arise out of the Insured Vehicle being used in a foreign country which We have agreed to extend this insurance to cover and the proceedings are brought or judgement passed in such country.

Personal Information Notice

How we will use or share Your information

Where we collect any personal information, You agree that any data provided by You in connection with Your proposal or resulting insurance may be used exclusively by Us, Extracover Limited trading as Zego, the Insurer and all respective group companies and/or their insurance brokers or third-party service providers (including but not limited to other insurance carriers, third-party claims adjusters/loss adjusters and investigators, solicitors, fraud detection and prevention services, reinsurance companies, governmental authorities and organisations acting on their behalf and insurance regulatory authorities), collectively referred to as ‘data recipients’, in performing their obligations to You in respect of Your contract of insurance and providing You with ancillary services, (the purposes). The purposes include, but are not limited to:

  • analysing Your particular insurance needs;
  • providing insurance estimate(s) or quotation(s) and/or arranging insurance cover;
  • checking against against anti-fraud databases;
  • populating national databases where required by law to do so;
  • handling and investigating claims and assisting in the claims authorisation process;
  • accounting and other management information purposes; and
  • for any purpose required by law, including regulatory and connected statutory bodies both during the period Your Motor Fleet Insurance Policy is in force and after it has lapsed.

Our lawful basis for processing is that:

  • You have given clear consent for the data recipients to process Your personal data for the purposes.
  • The processing is necessary for You to enter into Your insurance contract.
  • The processing is necessary for You to comply with the law.
  • The processing is necessary for the legitimate interests of the data recipients in respect of the purposes.

The data recipients may also need to process sensitive personal data about You where this is necessary (for example, physical or mental health conditions or criminal convictions in connection with both You and members of Your family or household). Where sensitive personal information relates to anyone other than You, You must obtain the explicit consent of the person to whom the information relates, both to the disclosure of such information to the data recipients and to its use for the purposes.

In the event of processing outside the United Kingdom / the European Economic Area (EEA), You agree to the transfer of Your personal information to a country or territory outside the United Kingdom / EEA (which may not provide the same protection for You). In the future, the Insurer and its group companies may (independently) sell their business(es) or assets. Personal information is usually considered an asset in such transactions and You agree that Your information provided in connection with and for the purposes of Your Motor Fleet Insurance Policy may be sold, traded or licensed in such circumstances.

Zego are not currently big enough to have a Data Protection Officer – we do not carry out large scale systematic monitoring or large-scale processing of special categories of data. Personal data are kept for a maximum of 7 years from the end of your Policy.

Your Rights

You have the right to withdraw Your consent to the data recipients processing Your personal information. However, the data recipients may continue to process Your personal information under one of the other lawful bases listed above.

You have the right to object to the continuing processing and we must inform You of the reasons.

You have the right to request Your personal data is erased and to prevent processing. This is not an absolute right and we may continue to process Your data if we have a lawful basis to do so.

In certain circumstances You have the right to request we restrict the processing of personal data supplied by You to Us.

You have the right to apply for a copy of Your information, free of charge (unless we believe Your request to be manifestly unfounded, excessive or repetitive).

You have the right to have personal data rectified if it is inaccurate or incomplete.

You have the right to data portability in respect of personal data provided to Us and processed by automated means. This means that You can request the data in a commonly used and machine-readable form and even that we transfer it at Your request to another organisation if this is feasible. This service is free of charge.

In making Your proposal for insurance You provide Your explicit consent to the use by the data recipients of automated decision making (making a decision solely by automated means without any human involvement), as necessary for the entry into and/or performance of Your insurance Policy. You have the right to request human intervention or challenge such decisions.

Insurance underwriting

We look at the possible risk in relation to Your prospective insurance policy (or anyone else to be covered under the insurance policy) so that we can:

  • Consider whether to accept a risk;
  • Make decisions about providing and dealing with insurance and other related services for You and

members of Your household;

  • Set premium levels for Your insurance policy; and

  • When You apply for insurance;
  • If there is an accident or a claim.

If You make a claim, we may need to release information to another person or organisation involved in that claim. This includes, but is not restricted to, others involved in the incident, their insurer, their solicitor or representative and medical teams, the Police or other investigators. We also may have to investigate Your claim and conviction history.

Under the conditions of Your insurance policy, You must tell Us about any incident (such as an accident or theft) which may or may not result in a claim. When You tell Us about an incident, we may pass information relating to it to Motor Insurance Bureau (MIB).

Keeping to legal responsibilities – Preventing or detecting fraud

We will check your information against a range of registers and databases for completeness and accuracy. We may also share your information with law enforcement agencies, other organisations and public bodies. If we find that false or inaccurate information has been given to us, or we suspect fraud, we will take appropriate action. If fraud is identified, details will be passed to fraud prevention agencies including the Motor Insurance Anti-Fraud and Theft Register run by MIB, Law enforcement agencies may access and use this information.

We and other organisations, including those from other countries, may also access and use this information to prevent fraud and money laundering, for example, when:

  • Checking details on applications for credit and credit related or other facilities;
  • Managing credit and credit related accounts or facilities;
  • Recovering debt;
  • Checking details on proposals and claims for all types of insurance;
  • Checking details of job applicants and employees.
